Question: My landlord wants to increase rent. Is that allowed?

Rent increase up to the local comparative rent

1. The rent must have been unchanged for 15 months, and the increase can be requested at the earliest one year after the last one (§ 558 Abs. 1 BGB).
2. Within three years it may rise by at most 20 %, in many cities only 15 % (§ 558 Abs. 3 BGB).
3. You have until the end of the second calendar month after receiving the request to decide (§ 558b Abs. 2 BGB).

„Bei Erhöhungen nach Absatz 1 darf sich die Miete innerhalb von drei Jahren, von Erhöhungen nach den §§ 559 bis 560 abgesehen, nicht um mehr als 20 vom Hundert erhöhen (Kappungsgrenze).“ § 558 Abs. 3 BGB
